By ordering hosting service from Host Bunnies, you agree to abide all of the terms listed below. If it is found that a site under your account does not follow these terms, Host Bunnies reserves the right to suspend your account without notice. Failure to correct content will lead to account termination.

(1) Prohibited activities
All services provided may only be used for lawful purposes. You will be held responsible for any unlawful content hosted under your account.
(2) Zero-Tolerance Spam Policy
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double optin" will be treated as spam. Any user who sends out spam will have their account suspended/terminated without notice.
We reserve the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this policy, at its sole discretion. We also reserves the right to make any such modifications in an emergency at our sole discretion.
We reserve the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is left entirely to the discretion of Host Bunnies. All rights reserved.
Invoices will be sent to the email address you provided 7 days in advance of the due date for monthly bills and 14 days in advance for yearly bills. If you are late in paying your invoice, we reserve the right to suspend your account immediately upon overdue. If you fail to pay the invoice after 5 days of your invoice due date, we reserve the right to terminate your account without advance notice. You are solely responsible for providing an active email address for your account in the client area and ensure emails from Host Bunnies is not in your spam list.
Accounts that are suspended due to late payment or exceedance of resources will not receive extension of service for the suspension period.
Host Bunnies accepts payments made through Paypal, including Paypal balance and credit card payments. Options of one-time payments and subscription payments are available.
(4) Refund Policy
All new clients who pay through our invoice system are protected by the 30-day money-back guarantee as stated by our website. Clients must submit ticket through the online helpdesk to request refund at least 30 days after your first payment. This guarantee does not apply to current customers who have used our services for over 30 days.
Host Bunnies does not offer refunds for account termination and/or suspension due to breach of this terms of service. The 30-day money-back guarantee is not in effect for terminated or suspended accounts. Customers can request partial (or full) refund only if one or more of the situations listed below occurs:
Only web hosting services are refundable. Domain names are not refundable, and refund amount of packages with free domain name included will be less the price of the domain name.
Daily off-site backups are kept for restoration purposes. Customer is responsible for making periodic backups of their webpages and the pages of their sub-accounts. Backups are kept for at least 7 days up to 14 days. This backup policy does not apply to suspended accounts. Host Bunnies will not be held responsible for any data loss.
(6) Usage of Resources
Client may not use over 15% of system resources for over 90 seconds.
Client may not use over 100% of the alotted space or bandwidth of your cPanel account. Exceeding the set limitation will result in account suspension, so you are advised to upgrade to a more appropriate package upon reaching 75% of your resources. Accounts that are suspended due to exceedance of resources will not receive extension of service for the suspension period. Notifications are sent out when your disk usage is nearing your account limit, but you are solely responsible for monitoring your own usage and Host Bunnies is not responsible for any loss caused by an interruption of your service(s).
(7) Usage of Scripts
All scripts, e.g. Wordpress and WHMCS, that are running on the server should be updated to the latest stable release in order to avoid possible security risks in running an older version.
2. CGI Scripts
CGI is enabled on each account, and you are allowed to upload any CGI script that you wish as long as it abides our terms. However, we reserve the right to disable any CGI script that effects normal server operation.
Clients cannot install their own chatrooms, as these scripts tend to be large system hogs. In the rare event of you in need of a chat room service for your domain, kindly request our support team to justify the cause. Even in such cases you are limited to one chat room for each cPanel account.
4. Background Running Programs
Background running programs are strictly prohibited our servers. We may, however, allow programs to run continually in the background. These are considered on a one to one basis and an extra charge will be incurred based on system resources used and operational maintenance needed. This however, is on the sole discretion of the support team.
(8) 99.9% Uptime Service Level Agreement
Host Bunnies guarantees 99.9% monthly service uptime. This equivalents to a maximum of 45 minutes downtime any month. According to the uptime structure for a given month shown in the table below, you may submit a support ticket to be compensated with a percentage of your next invoice amount in account credits up to a maximum of 100% of your next invoice. For annual billing terms, the base amount for calculating compensation per month is calculated by the amount of your annual bill divided by 12.
Compensation request must be made within 5 days of the outage month in order to be valid. Downtime due to scheduled maintenance, non-server-equipment-related issues, catastrophies and natural disasters are not counted towards compensatable time.

(9) Disclaimer and Indemnification
We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services we provide. We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by us and our employees.
Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless any liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with us; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from our servers.
(10) Changes in TOS
We have the rights to change our terms of service any time without prior notice. Any hosted content must abide by the change of terms.
